What is a bail bond?
The money posted by a "bondsman" for a defendant who cannot afford his bail. The defendant pays a certain portion, usually 10%. If the defendant fails to appear for a court hearing, the judge can issue a warrant for his/her arrest and threaten to "forfeit," or keep, the money if the defendant doesn't appear soon. Usually, the bondsman will look for the defendant and bring him back, forcefully if necessary, in order to avoid losing the bail money.
What do I need to bond a person out of jail?
You will need the necessary fee, a co-signer, and perhaps some form of collateral.
Is the bail bond fee refundable?
No. Once a bail bond has been posted for the accused, the money is then earned by the bail bond company.
How do I know when the defendant has to go to court?
The court will send out a notice to the defendant by mail or each time the defendant goes to a court date will notify the defendant while in court. Additionally, an agent from our company will call the defendant prior to the court date to notify them of their court date.
If I'm a co-signer for a friend or family member who happens to miss court, do I have to pay you the full bond value?
In most cases a bonding company will be able to return the person who failed to appear in court to jail by using recovery agents. As the cosigner, you will be liable for the expenses of the bond hearing to return the defendant to jail. While there is no excuse for missing a court date, we strongly suggest to all our clients to notify us if any unusual circumstances come up so that we can advise them on the best course of action.
